TERMS AND CONDITIONS WAIVER AND RELEASE OF LIABILITY: STUDENT AGREES AND REPRESENTS ON BEHALF OF THERE SELF THAT ANY CLASSES AND USE OF FACILITIES SHALL BE AT STUDENTS OWN RISK AND SHALL INDEMNIFY AND HOLD HARMLESS, NOTTER SCHOOL OF PASTRY ARTS THE "LLC" AND/OR ANY AFFILIATED COMPANIES AND/OR THE RESPECTIVE AGENTS AND EMPLOYEES FROM ANY AND ALL CLAIMS, DEMANDS, INJURIES, DAMAGES ACTIONS OR CAUSES OF ACTION RELATING TO THE USE OF THE FACILITIES AND/OR EQUIPMENT OF THE LLC OR OF ANY AFFILIATED COMPANIES OR OF AGENTS OR EMPLOYEES THEREOF, WHETHER OR NOT SUCH CLAIMS, DEMANDS, INJURIES OR DAMAGES ARISE OUT OF THE NEGLIGENCE OF THE LLC, ITS AGENTS OR EMPLOYEES. IN CASE OF AN ACCIDENT, STUDENT AGREES THAT THE INJURED PARTY WILL BE EXAMINED AT STUDENT'S OWN EXPENSE BY A LICENSED PHYSICIAN WHO SHALL REPORT IN WRITING TO BOTH THE INJURED PARTY AND THE LLC OWNING THE SCHOOL. IN THE EVENT ANY ACTION IS BROUGHT AGAINST THE LLC OR ANY AFFILIATED COMPANIES OR IT'S ASSIGNS IN WHICH THE COURT FINDS THERE WAS A COMPLETE ABSENCE OF A JUSTIFIABLE ISSUE OF EITHER LAW OR FACT OR THE LLC OTHERWISE PREVAILS IN SUCH AN ACTION, THE DEFENDING LLC OR COMPANY SHALL RECEIVE FROM THE PARTY BRINGING SUCH AN ACTION ITS COST AND ATTORNEY'S FEES. NOTTER SCHOOL OF PASTRY ARTS, LLC RULES AND REGULATIONS Hours of operation—operating schedules will be subject to change from time to time. We are open from 7:30 AM to 5:00 PM, Monday thru Friday 1. Safety regulations—student will not start a machine or other device until instructed by instructor. 2. Compliance with rules and conduct of student- student agrees to be subject to the control and guidance of staff instructor of the school while on the premises and will follow instructions of the school personnel. Student agrees to conduct them self in a well mannered fashion while on the premises. 3. Personal property—the LLC owning the school, and the agents and employees of both shall not be responsible for damaged, lost or stolen articles of clothing or any personal property of any student. 4. Warranties—student agrees that no warranties, representations, or agreements were made to student except for those written herein or in writing. 5. The school reserves the right to amend or add to these rules and conditions or to adopt new rules. 6. Change of classes—school retains the right to change the class subject, cancel the class and/or instructor without notice. 7. All firearms are strictly prohibited and not allowed on Notter School Premises 8. Dress code—proper kitchen attire including but not limited to proper no healed shoe not over ¼”  Non slip kitchen shoe, Chef Jacket. 9. All video is prohibited without the written consent of Notter School of Pastry Arts, L.L.C. 10. All carry in food is prohibited due to the sensitive nature of our chocolates. 11. Cell Phones are not permitted in classrooms.
